Get Your Children To Listen To You - Every Time You Speak

Top communicators use a simple principle that guarantees that their kids take notice of them. They use the proximity principle to great effect.

I learned about the proximity principle as I observed good communications and behaviour management practice of children by adults (both teachers and parents) over a period of time. The good operators, I noted, were conscious of the time, place and space they worked in when dealing with children, particularly those kids who were upset or angry.

Okay, what is the proximity principle ?

The proximity principle is about making the best use of time, place and space to maximise our communication with others. Lets look a little closer.

If you want your children to take notice of you and really hear you then you need to move into their proximal space, which is different to invading their personal space. A childs proximal space is that space that is about an arms length away. Move closer and you are invading their personal space. This is okay with some children but for many this just sends them off as they feel threatened.

You also need to consider the timing of your communication. As a general rule, avoid talking with kids when either you or they are angry as you can talk until you turn blue and they wont listen. You also need to be mindful of the place where communication occurs. For instance, kids are more receptive to messages when you are both seated as this is the conversation position. Also speaking in private is also more effective than speaking in public.

The proximity principle is a simple idea but it has wide application. Lets look at some examples.

A mother at the beach was yelling at her five year old to stop throwing sand. At ten metres away from her child she received little joy. She then moved into her sons proximal space (about a metre away), which meant she lowered her voice and made eye contact. The result was her son stopped throwing sand and changed activities.

A teenager came home from school and was greeted with a how was your day? from her high energy dad. Her response was a disinterested shrug. Dad changed tack and waited until his daughter was seated and sat near her and began a conversation. This time he made a connection. The timing was better but he also made use of space by moving close, making eye contact and then launching into a conversation. She was far more receptive.

A ten-year-old throws a tantrum in the supermarket as his mother wouldnt buy a certain item. His mother avoids getting into conflict here. Basically, she just grins and bears it but she doesnt give in. Later at home she sits down near him when he is relaxed and revisits the situation. He is more open to listening to his mother as she has made good use of the proximity principle of time, place and space.

The proximity principle is blindingly obvious however, due to many factors, we often neglect to use it. I know when my communication falls on death ears its usually because I have neglected some aspect of the proximity principle. Now, I am letting you in on some of my real secrets! Communication is all about the little things like timing, space and place the proximity principle. Practise it and put it to good use and youll wonder why you didnt use it before.

Will Technology Replace The Classroom?

As an educator, I see the advances of technology fast replacing the educational dinosaur, we call a classroom.

Questions we all need to ask ourselves:

1. What do we think an education is for?
2. How do we educate our children?
3. Do we teach people skills or values?
4. Are we teaching children to think creatively?

Students are very savvy in the use of computers, as they have access to all sorts of information. It's like going to the library, but without the bother of driving there. Of course there is always the problem of "going to the library"; and not reading anything.

We need to start instructing students in the use of computers, zeroing in on seven core skills: defining, accessing, managing, integrating, evaluating, creating, and communicating information. The seven core skill areas can be broken down into simple tasks for elementary students, and built upon as the students progress in their knowledge of computer skills.

I just finished reading Neil Postman's, "Technopoly", which takes an opposing viewpoint to the value of technology in our society. The reality is, that technology is here to stay and it becomes more advanced and sophisticated every day. Computers have tooling and format information programmed into them so that spelling, grammar, and page set up can be automatically checked and, in some instances, done for you. Technology especially computers) continue to make our lives more efficient by saving us time, energy, and the ability to communicate on a global scale using various network systems available to computer users. Many programs available to computer users actually teach people of all ages various skills that used to be taught in the classroom. Since this is the case, then why is formal education even necessary? The question provides educational food for thought.

I've been thinking a lot about synchronicity, about that intersection between saying "I want this" and seeing it show up. This is Magic.

Manifestation is what you create with your own hands. "Manifest", quite literally, means "gripped by the hand" (manus--hand, festus--gripped).

Magic and Manifestation together are the marriage of your actions and the universe's assistance, the fuel and the fire.

Today's featured article focuses on the five secrets to grow your capacity to make your dreams come true:

* Set inspired, aligned goals.

I you're not reaching a goal, take a look at your goal. How do you know this is right for you at this time?

Use your intuition instead of your ego. Find that inspired, joyful place in yourself, and ask what's going to happen this year, what you're meant to achieve. Allow your answers to come back to you. And see that anything you take on feels right and supports where you desire to go in the long term.

Trust your source of aligned, inspired wisdom to guide you to goals that fulfill themselves.

* Underpromise, overdeliver.

Most people overestimate what they can accomplish in the short term and underestimate what they can accomplish in the long term.

If you always promise less than you can do, you can always give more than you promise. Wouldn't you like to be known as (and know yourself as) the person who follows through and then some?

Give your results more time to happen. Take smaller steps. Rack up your wins. Build your confidence, integrity, and momentum. These are very attractive qualities.

* Focus on the progress instead of the gap.

Do you ever psych yourself out with all the stuff you haven't accomplished? You can make yourself a winner or loser by where you put your focus.

The more you focus on lack, the more lack you will see. The more you focus on abundance, accomplishment, and magic, the more they will appear in your life.

Human beings have amnesia. Studies have shown that we naturally remember the bad stuff more easily than the good stuff.

Counterract that amnesia. Keep daily records of your successes. Give yourself credit for at least five good things a day. When you feel scared or scarce, make a list of what you're grateful for. When you plan for the next year, make a comprehensive list of all you accomplished the year before.

* Cut down your "must-do" list.

Put things off and cut things out.

Too much stuff creates overwhelm, and overwhelm can stop you in your tracks. So set your priorities for the next three months. Anything that can be done six months or nine months from now should be scheduled for later in the year. Focus on what is here now, and know that the other stuff will be done in its designated time.

And do less. This is the 80/20 rule: 80% of what you do yields 20% of your results. 20% yields you 80% of the results. Identify your highest impact activities and put those first! Look at what you can delete or delegate from the rest.

* Partner with the universe.

The whole idea behind Magic and Manifesation is Partnership: you don't have to do it all on your own. There's your job, and there's the universe's job. Your job is what you can control--your actions, your mindset, your game plan. Anything that is outside of your control is the universe's job. Let it go. Focus on your job.

First you set the goals that are within your control, are easy or manageable.

Then you play: set a goal that is just outside your control. Every week, ask for the universe's help in one thing. Start small. (Practice on parking spaces.) Make your request, let it go, and see what happens. It's a game.

As time goes on you'll see more and more of these requests coming to pass. You'll find thoughts like "I'd like to" or "It would be nice if" bringing those opportunities to you.

Then you step back into your job: accept the opportunity and do what needs to be done, or decline it and do what needs to be done. And thank the universe for playing!

A History of Safety

Throughout history, the safety and health movement has been impacted by legislation. In the following safety and health chronology, noteworthy events, individuals, and legislative action are set forth to illustrate the theme that the safety professional/practitioner is and has been a significant part of those preventive experiences making up the story of life.

The Ancient Chinese (c 2,500 BC) spread the risk of loss by placing 1/6 of their harvest on each of six boats traveling to the market.

Hammurabi (c 2,000 BC), ruler of Babylon, was responsible for the Code of Hammurabi, part of which bears resemblance to today's workers' compensation laws.

Ancient Egyptians (as early as 1600 BC) recognized the hazards of breathing the fumes produced by melting silver and gold.

Hippocrates (c 460-c 377 BC), the father of contemporary medicine, established a link between the respiratory problems of Greek stonecutters and the rock dust surrounding them.

In ancient Rome, the few slaves who survived the dangerous task of ship launching were given their freedom.

In 1601, the first English statute on "assurance" (an earlier term for insurance) was enacted. This statute covered marine risks.

In 1667, the Great Fire of London (September 2-7, 4666), caused the first English fire insurance laws to be enacted.

In 1700, Bernardino Ramazzini, an Italian physician, published the first thesis attempting to prove the connections between occupation and disease.

In 1896, an association to prevent fires and write codes and standards, the National Fire Protection Association (NFPA), was founded.

In 1902, the state of Maryland passed the first workers' compensation law.

In 1904, the first attempt by a state government to force employers to compensate their employees for on-the-job injuries was overturned when the Supreme Court declared Maryland's workers' compensation law to be unconstitutional.

On March 21, 1911, in the Asch Building in New York City, nearly 150 women and young girls died in the Triangle Shirtwaist Factory Fire because of locked fire exits and inadequate fire extinguishing systems. A major turning point in history, this fire changed regulation by the government and laws instituted to protect workers.

In 1911, a professional, technical organization responsible for developing safety codes for boilers and elevators, the American Society of Mechanical Engineers (ASME) was founded. A17 Safety Code was published.

1911-1915, During this five-year period, 30 states passed workers' compensation laws.

In October 14, 1911, the American Society of Safety Engineers (ASSE) was founded in New York City. Originally named the United Society of Casualty Inspectors. The ASSE was dedicated to the development of accident prevention techniques, and to the advancement of safety engineering as a profession.

California Railroad Commission, now known as the California Public Utilities Commission, ws created by constitutional amendment to oversee rail safety, including the safety of highway/rail crossings.

In 1912, a group of engineers representing insurance companies, industry, and government met in Milwaukee to exchange data on accident prevention. The organization formed at this meeting was to become the National Safety Council (NSC). (Today, the NSC carries on major safety campaigns for the general public, as well as assists industry in the development of safety promotion programs.)

In 1916, the Supreme Court upheld the constitutionality of state workers' compensation laws.

In 1918, the American Standards Association was founded. Responsible for the development of many voluntary safety standards, some of which are referenced into laws, today, it is now called the American National Standards Institute [ANSI].

In 1931 the Uniform Traffic Code was established because of the increase in speed and volume of motor vehicle traffic and accidents. The code consists of four separate acts: motor vehicle registration, driver licensing, automobile anti-theft and uniform traffic regulations.

In 1936, Frances Perkins, Secretary of Labor, called for a federal occupational safety and health law. This action came a full 58 years after organized labor's first recorded request for a law of this nature.

In 1936, the Walsh-Healey (Public Contracts) Act passed. This law required that all federal contracts be fulfilled in a healthful and safe working environment.

By 1948, all states (48 at the time) now had workers' compensation laws.

In 1952, Coal Mine Safety Act (CMSA) was passed into law.

In 1960, specific safety standards were promulgated for the Walsh-Healey Act.

On Jan 3, 1961, an accident at an experimental nuclear reactor at a federal installation near Idaho Falls, ID kills three workers. These were the first deaths in U.S. nuclear reactor operations.

In 1966, the Metal and Nonmetallic Mines Safety Act (MNMSA) was passed.

In 1966, the U.S. Department of Transportation (DOT) and its sections, the National Highway Traffic Safety Administration (NHTSA) and the National Transportation Safety Board (NTSB), were established.

In 1968, President Lyndon Johnson called for a federal occupational safety and health law.

In 1969, the Construction Safety Act (CSA) was passed.

In 1969, the Board of Certified Safety Professionals (BCSP) was established. This organization certifies practitioners in the safety profession.

In 1970, President Richard Nixon signed into law the Occupational Safety and Health Act (OSHA), thus creating the OSHA administration and the National Institute for Occupational Safety and Health (NIOSH).

In 1970, on January 1, the National Environmental Policy Act, (NEPA) was signed. This provided a national charter for protecting and improving the environment and created the Environmental Protection Agency (EPA).

On May 29, 1971, the firast OSHA standards were adopted to provide a baseline for safety and health protection in American workplaces.

In 1972, the Consumers Product Safety Act (CPSA) was signed into law.

In 1976, The Resource Conservation and Recovery Act (RCRA) passed and became the instrument by which the management of hazardous waste is regulated.

In 1980, to address the issues of hazardous waste management, the Pollution Liability Insurance Association (PLIA) was formed.

Jan 16, 1981 OSHA updates business electrical standards to simplify compliance and adopt a performance approach.

1991 North Carolina Plant Fire kills 25 workers and 49 injured at the Imperial Chicken processing plant in Hamlet NC. The employees were trapped inside due to padlocked doors meant to keep vandals away.

Sep 11, 2001, 2886 work related fatalities including 537 rescue workers, resulted from terrorist attacks on the NY City World Trade Center, at the Pentagon, an on the planes that crashed.

The Legality Of P2P File Sharing Software

The legality of free p2p file sharing software has always been in question, and the p2p networks have been in the news again recently: when are they ever out of it! I have made my views known about those that make a fortune from us while breaking the law themselves with their drug-taking and other anti-social activities, but what exactly is the legal situation?

Peer to peer file sharing is not illegal. That is fact! A few friends sharing files online between themselves is no more illegal than them swapping CDs or DVDs. Where the confusion arises is the scale. At what scale of sharing does it become illegal, rather than just people swapping their belongings.

It is certainly illegal when individuals, or even companies, download material using p2p software in order to create CDs and DVDs for sale in the same way that is was illegal for these same people to copy audio tapes for sale. That is understandable and nobody could realistically condone such behaviour. It is no illegal, however, for you to allow others to copy files from your computer as long as you are not doing so for gain. However, if these files are copyrighted, it is illegal for the copier to copy them.

There appears to have been a distinction made between downloading others files and swapping their physical hardware. In other words, you can give your friend your Elton John album in exchange for his Prodigy album, but not for you to download a copy of his album, and he yours.

Perhaps rightly so, and I believe most would agree were it not for the double standards being operated, and the lack of firm direction on behalf of the artists themselves. Artists who are more than happy to have their work downloaded by interested listeners or viewers when they are trying to make their name, but take the opposite view once these same fans have promoted them to the position that they desired.

Actual court cases have been sending out mixed signals over the years, though it is a fact that breaking of copyright is illegal. P2P file sharing is not illegal as long as the files being shared are not copyrighted. However, most movies, videos and MP3s that are downloaded are done so illegally. The vast majority of P2P software is being used illegally, but if you consider the number of downloads compared to those actually prosecuted, you have a higher chance of being killed by a coconut falling on your head than you have of being prosecuted for an illegal download.

The important thing is that you dont overdo it, and make a business of recording the downloads onto disks and selling them. These are the people the music and video companies are mostly after, though it is true that a few high school kids have also been fined. They are by far in the minority though.

You can reduce the risk if you download but do not share. If you own p2p software, then turn of the file-sharing option that allows others to access your hard disk while your computer is switched on. Just about every peer to peer file sharing software package allows you to switch this off. The authorities are looking for those who commercialize their downloads in a big way by compiling pirate albums, and those who share thousands of files on their computer with others throughout the internet.

In order not to break the law, do not download any music or video file that does not specifically give permission. Many artists, bands and new film makers do give this permission, if not in actual writing, then at least tacitly. This is especially true of those up and coming artists who want to have their work published throughout the internet. A lot of single tracks from albums are offered for free download in the hope that the listener or viewer will purchase the whole thing. If you decide to break the law, then the chance you take is minimal. But you never know . . .

However, it is ludicrous that drug-taking lawbreakers should be complaining about others breaking the law. These same people would have been delighted at having their work downloaded before they were famous, and that is one of the major benefits of file sharing to young or new artists. They get their work and their name known by offering their products free of charge to those that want to download it, and many do.

However, once they have made their name they rapidly pull the plug on the free downloads, and those who supported them when they were struggling suddenly find themselves breaking the law. Little wonder that the legal eagles the world over cannot agree on what is allowed and not allowed.

Certainly, copyright should not be infringed, but hypocrisy should not be allowed to prevail over people who wish to listen to single tracks that they would otherwise find impossible to access. There should surely be little wrong with an individual downloading a track otherwise unavailable, and then purchasing tickets to watch their idols (or perhaps idles?) playing or singing live.

In case anyone laughs at this interpretation of one of the main uses of file sharing, it is in fact what happens in many cases. Why should somebody have to purchase a complete album to determine whether or not a particular artist is worth listening to for a $100 ticket for a live show?

If used properly, peer to peer file sharing and downloading can be used to the advantage of the artist. Rather than complaining that high school kids can make better use of the internet than them, media moguls should waken up and realise that the second decade of the 21st century is only 3 years away while they are still living in the 20th.

If they are unable to use modern technology to their benefit, then they should not castigate those that can.
